The Former Member of South Jos East in the Federal House of Representatives Hon. Bitrus Kazi has disclosed that the once upon a time ruling People’s Democratic Party ((PDP) in Plateau State does not suppose to operate in total negligence of the constitution of the Federal Republic of Nigeria
Kazi who was a guest in Highland FM Jos and was monitored by News Parrot stated that he is not a lawyer but his understanding of Nigeria law as a Former lawmaker, that a most popular lawyer can air his views or opinion but a weakest Magistrate seating on the seat of judgement passed a judement unless if upturned by a higher court of jurisdiction that judgement is the position of the law.
Speaking on whether if the victory of the PDP is on jeopardy?
Hon Kazi stated that, he had aired his position to the PDP in written, he said he had address the State Exco, he had address the State Caucus, and they will all bear him witness on this matter repeatedly.
Hon. Kazi further revealed that he had cause when Sen. Ogbeha was on the Plateau he drove to his house and told him sir to him there is cause for alarm in point A, B, C but when the party told him that there is no cause for alarm and also the position of the party was at variance with the court.
He said now if you take it to another court will the court listen to the opinion of the party? Which in any case appeared in the court, was represented in Court, make the same opinion in court but was overruled by the same court.
And then you insist on an opinion that the court said on this matter you are wrong.
Hon. Kazi furthermore disclose that in that case who should the party listen to, on the matter that you approach the judiciary with who are you supposed to listen to he asked?
He said is it the position of the court or the position of the Illegal Exco?
He said the PDP does not suppose to be a party that opporate in total negligence of the constitution of the Federal Republic of Nigeria.
He said he have said repeatedly, PDP, Labour Party, APC and all Political parties derived their powers from the constitution of the Federal Republic of Nigeria.
The Political parties never made Nigeria, they never made the constitution of Nigeria rather the constitution of Nigeria made all the Political parties and it is clearly provided in the constitution that every Political party most be guided by a constitution that promotes democratic governance and it is clearly there.
He further said that one never had a setuition whereby the party made the country or the party made the constitution of the Federal Republic of Nigeria.
But is it is the constitution of the country that give the lifeline to the Political parties constitution.
Hon. Kazi also revealed that the State party Chairman said if they are not satisfied with the with them they should take the National party to court.
And the court has come to the position that PDP was challenged as PDP not Plateau State or Local Government PDP but PDP and that is why the first respondent was Wadata Plaza.
All the other respondent are just respondent attached to Wadata Plaza.
And so the Idea that it is the Federal or the State or the Local Government.
Furthermore Hon. Kazi also revealed that a court judgement can not and will never be an opinion but a stamp.
He said the effect of the judgement was there, just like when the Chris Hassan went to Makurdi Benue State in April 2021 for Zonal Election the PDP stopped them from voting and the report of INEC was there true satisfied copy that’s an effort of the judgement, he said when the PDP were to go for Local Government Election, the PDP was stopped via a court judgement that was another effect.
He also revealed that there was a bye election in Pankshin South and Jos North Bassa Federal Constituency the PDP was also affected.
