The Majority leader of 9th Plateau State House of Assembly Hon. Naanlong Daniel Gapyil has call on the security operative and the people of the State to hold Governor Caleb Mutfwang accountable in the event there is break of law and order in the State.
Hon. Naanlong made the call in an exclusive interview he granted to this medium yesterday 9, June 2023 in Jos, he stated that the recent action of Governor Mutfwang to illegally suspend the duly elected Local Government Council Officials is a call to anarchy he said.
Speaking on whether or not the State House of Assembly has power to either suspend or remove elected Local Government Official, Hon Naanlong stated that best on the power bestowed on House, by the constitution of the Federal Republic of Nigeria, in relation to the existence of the local government, and the power that they can exercise over the local government.
He said there is no any portion that the House of Assembly is giving that order.
He said whatever Plateau people are hearing nothing but the gathering of some PDP members who have decided to apportion some positions for themselves and take decision on behalf of the majority House of Assembly, to suit the yarning and expectations of their party.
Furthermore, Hon. Naanlong also that they have tried to follow the law, but they realise that local government laws and under the constitution of Nigeria section 7 which he read as follows.
” The system of local government by democratically elected Local Government Council is under the constitution guaranteed, and accordingly the Government of every State shall subject to section 8 of this constitution.
Ensure their existence under a law which provides for the establishment, structure, composition, finance and function of such council”.
The Majority leader also revealed that the law does not in any way give power to Executive Governor whether suspension or removal of an elected constituted executive of the local government not even the House of Assembly.
He said, section 7 is very clear, which is talking about making the laws, for the third tier of Government which is the local government.
He also revealed that in the local government law is very clear that the people who have power to exercise over the local government executive are the local government Councillors.
He also stated that the local government law does not have room for caretaker Committee neither does it have room for Transition Committee .
The lawmaker also disclosed that he does not expect the Governor who is a legal practitioner to wait for someone to interpret the constitution for him expect if he decided to be a lawbreaker.
He also revealed that the PDP are known for not respecting the law of the land.
Also speaking on the suspension of the newly employed workers in the State by the former administration of Barr. Simon Bako Lalong, Hon. Naanlong totally condemned the action of Governor Mutfwang.
Reacting over the action of the embattled Jos North Local Government Council Chairman Hon. Shehu Bala Usman, who decided to resume office yesterday 9, June, 2023, the lawmaker said it a right step in the right direction because as far as the constitution of the Federal Republic of Nigeria is concerned, nobody apart from the elected Councillors have the right to remove or to suspend an elected Local Government Chairman.
Hon. Naanlong further encourage other suspended Council Officials to return back to their respective offices as he said no competent court of jurisdiction can support such impunity because the Governor has no such power or either the House of Assembly to remove or suspend them he said.
